  • AVAILABILITY OF SERVICE 

The items offered through this website are only available for shipping to European territory.

  • HOW TO PLACE AN ORDER 

To place an order, you must follow the online purchasing procedure and click on "Authorize payment". After this, you will receive an email acknowledging receipt of your order ("Order Confirmation"). We will also inform you by email that the product is being shipped ("Your order has been shipped"). This will be through our transport agency where both the status and the tracking number of your shipment will appear.

  • TECHNICAL MEANS TO CORRECT ERRORS

In case you detect that an error has occurred when entering your personal data during your registration as a user of this website, you can contact customer service by phone at 910597342, WhatsApp, or by email  at aloha@baiafood.com.

This website displays confirmation windows in various sections of the purchase process that do not allow you to proceed with the order if the data in these sections have not been provided correctly. Likewise, this website offers the details of all the items you have added to your basket during the purchase process, so that, before making the payment, you can modify the data of your order.If you detect an error in your order after completing the payment process, you must immediately contact our customer service, at the phone number or email address previously mentioned, to correct the error.

  • PRODUCT AVAILABILITY

All orders are subject to product availability. If there are difficulties in supplying products or if there are no items in stock, we will refund any amount you may have paid.

  • DELIVERY

Before placing the order, you must select the delivery method that best suits your needs.Unless we have agreed otherwise, we will send you the order consisting of the products listed in each Shipping Confirmation without any undue delay and no later than 30 days naturalfrom the date of the Order Confirmation.

Please note that there are unforeseen or extraordinary circumstances that may affect the delivery date. If for any reason we are unable to meet the delivery date, we will inform you of this situation and give you the option to proceed with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid.

  • IMPOSSIBILITY OF DELIVERY

  • TRANSFER OF RISK AND OWNERSHIP

The risks of the products will be your responsibility from the moment of delivery. You will acquire ownership of the products when we receive full payment of all amounts due in relation to them, including shipping costs, or at the time of delivery (as defined in the previous clause), if this takes place at a later time.

  • PRICE AND PAYMENT

The prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due. Prices may change at any time, but (except as set out above) potential changes will not affect orders for which we have already sent you an Order Confirmation.Once you have selected all the items you wish to purchase, they will have been added to your basket, and the next step will be to process the order and make the payment. To do this, you must follow the steps of the purchase process, filling in or checking the information requested at each step.

Furthermore, during the purchase process, before making the payment, you can modify the details of your order. You may use Visa, Mastercard, PayPal, Amazon Pay as payment methods, or pay in installments with Scalapay.

  • VALUE ADDED TAX AND BILLING

In accordance with the provisions of Article 68 of Law 37/1992, of December 28, on Value Added Tax, the delivery of the items shall be deemed to be located in the Spanish VAT territory if the delivery address is in Spanish territory except for the Canary Islands, Ceuta, and Melilla.The applicable VAT rate will be the one legally in force at any given time depending on the specific item in question. For orders destined for the Canary Islands, Ceuta, and Melilla, deliveries will be exempt from VAT by application of the provisions of Article 21 of Law 37/1992, without prejudice to the application of the corresponding taxes and duties in accordance with the regulations in force in each of these territories. You expressly authorize us to issue the invoice in electronic format, although you may indicate at any time your wish to receive an invoice in paper format, in which case, we will issue and send the invoice in said format. You may request this by contacting our customer service, through any of the means made available to you and free of charge.

By accepting SMS marketing from BAIA at checkout and initiating a purchase or subscribing through our subscription tools, you agree to receive recurring text notifications (for your order, including abandoned payment reminders), text marketing offers, and transactional text messages, including our review requests, even if your mobile phone number is registered on any state or federal do not call list.

The frequency of messages varies. Consent is not a condition of purchase. If you wish to unsubscribe from receiving notifications and text marketing messages, reply STOP to any mobile message we send you or use the unsubscribe link we provide in any of our messages.

You understand and agree that alternative opt-out methods, such as the use of alternative words or requests, will not be considered a reasonable means of opting out.
